The European Court of Human Rights (hereinafter: the Court) is on October 17, 2024. made, and on November 14 of the same year, announced the decision in the case Ljubica Marić against Serbia, number 49974/20.
It's a decisionpassed unanimouslythree-member Board.
The applicant submitted a petition to the Court on November 4, 2020, complaining of a violation of her rights under Article6.attitude 1. Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter: the Convention), due to the alleged absence of impartiality of the Constitutional Court,because the panel of the Constitutional Court that decided on her constitutional appeal also included a judge who had previously decided on the same case as a judge of the Supreme Court of Cassation.
The Government of the Republic of Serbia isinformed the Court that the aforementioned judge was excluded from the proceedings, as well as that her inclusion in the panel of the Constitutional Court in the given case was an administrative error which the Constitutional Courtcorrected on October 13, 2022 and informed the applicant about it.
Taking into account the above, the Court determined that the matter was resolved at the domestic level in the sense of the article 37th paragraph 1 (b) of the Convention, as well as that respect for human rights, as defined in the Convention and its Protocols, does not require the Court to continue the examination of the petition under Article 37th paragraph 1.in fine.
Consequently, the Court deleted the petition from its list of cases.
